Official Rules of Play

PURCHASE NECESSARY: There are two ways
to enter: (1) Subscribe to Dole Nutrition News before
April 1, 2009 (11:59 PDT) by completing the subscription form
located at www.dolenutrition.com/news_subscribe.aspx.
You will be automatically entered into the prize drawing when
you subscribe. (2) If you wish to enter the sweepstakes
without subscribing to Dole Nutrition News, send your
name and e-mail address in an e-mail to dolenutrition@rescocompany.com with DOLE NUTRITION INSTITUTE/SMOOTHIE MAKER SWEEPSTAKES
in the subject line. Limit one entry per e-mail address.
Contest starts February 28, 2009 and ends April 1, 2009 (11:59
PDT).

PRIZE: One (1) 1st Prize: A Vita-Mix 5200 Blender, plus Coupons for four (4)
free bags of DOLE Frozen Fruit, Approximate Retail Value (ARV)
of each 1st Prize package $500 each. Odds of
winning any prize depend upon the total number of eligible
entries received. Limit one prize per household.

ELIGIBILITY: Sweepstakes open to
legal residents of the United States who have reached the age
of majority in his/her state of residency and who have a valid
e-mail address. Owners, employees and immediate families
(spouses and parents, siblings and children and their spouses)
of Dole Food Company, Inc., their respective affiliates or
subsidiaries, promotion and advertising agencies, and any
other company involved with the design, production or
execution of the promotion are not eligible to
participate.

GENERAL: Winner will
be selected in a random drawing conducted by an
independent judging
organization on or about April 15, 2009 and will be notified
by e-mail on or about May 1, 2009. The prize winner must
claim the prize by responding to the prize notification e-mail
with the information requested, which is necessary to validate
eligibility and deliver the prize. Failure to claim the
prize within thirty (30) days of prize notification will
result in the prize being forfeited by the winner.
Sponsor, at its discretion, may or may not award a forfeited
prize to another entrant. Winner assumes the risk of
safe arrival of prize. Sponsor is not responsible for
lost, misdirected or stolen mail, or unsafe arrival of a
prize. Sponsor is not responsible for entries that are
altered, defective, delayed, deleted, destroyed, fraudulent,
improperly accessed, inaccurate, incomplete, interrupted,
invalid, late, lost, misrouted, non-delivered, stolen,
tampered with, unauthorized or unintelligible; or any
printing, production, technical, electronic or other errors;
or for lost, interrupted or unavailable network, server or
other connections; miscommunications; failed phone, computer
hardware or software or telephone transmissions; technical
failures; unauthorized human intervention; on-line traffic
congestion; garbled or jumbled transmission; undeliverable
e-mails resulting from any form of active or passive e-mail
filtering; insufficient space in entrant's e-mail account to
receive e-mail; or other errors of any kind, whether due to
electronic, mechanical or human error or other causes; even if
caused by the negligence of Sponsor or its agents
(collectively "Invalid Entries"). All Invalid Entries
will be disqualified. In the event of a dispute
regarding the identity of the person submitting on entry, the
entry will be deemed to be submitted by the person in whose
name the e-mail address is registered. All materials
submitted become the property of Dole Food Company, Inc. and
will not be returned. E-mail addresses collect through
this contest will not be shared with 3rd parties
except to the extent necessary to distribute the prizes and
Dole Nutrition News. By participating entrants
agree to be bound by these rules and the decisions of the
judges, which are final in all matters relating to the
Sweepstakes. By accepting the prize, winner acknowledges
that he/she is eligible to claim a prize and consents to the
use of his/her name and/or likeness for advertising/trade
purposes without further compensation, unless prohibited by
law. All federal, state and local laws and regulations
apply. Sweepstakes void where prohibited by law.
Any tax liability is the responsibility of the winner.
Any required tax reporting forms will be furnished to the
Internal Revenue Service. Winner, by acceptance of
prize, agrees to release Dole Food Company, Inc., its
affiliate companies, subsidiaries, and agencies from any and
all liabilities for injuries, damages or losses of any kind to
persons or properties which may be sustained in connection
with the prize or any prize-related activity. As a
condition of entering, participant agrees that all disputes
arising out of this promotion shall be resolved without resort
to litigation. Prizes are not exchangeable or
transferable and cannot be redeemed for cash. In the
event of unavailability of stated prize, Sponsor reserves the
right to substitute a prize of equal or greater value.
5) WINNERS
LISTS: To obtain
list of prize winners (available after May 15, 2009), send a
self-addressed, stamped envelope to: DOLE NUTRITION
INSTITUTE/SMOOTHIE MAKER SWEEPSTAKES, P.O. Box 810, Hudson, WI
54016-9877 by June 1, 2009. VT residents may omit
postage.
